 Conditions of Auction
 
 


I. THE AUCTION
1. The auction shall be conducted voluntarily in the name, onn the orders and at the cost of a third party on immediate payment
in HUF. The Auctioneer shall act merely as an intermadiary between seller and buyer. The municipal and national authorities or
their representatives shall assume no liability for the activities of the Auctioneer.
2. The lots shall be knocked down to the highest bidder. Where two bidders offer the same price, the item shall go to the first to
have bid. A supplement of 15% shall be added to the hammerprice of the lot.
The bids shall rise by steps of:
to 2 000 Ft 100 Ft
from 2 001,- to 5 000 Ft 200 Ft
from 5 001,- to 10 000 Ft 500 Ft
from 10 001,- to 20 000 Ft 1 000 Ft
from 20 001,- to 50 000 Ft 2 000 Ft
from 50 001,- 10%
3. Once knocked down, the lot must be collected. The lots will be released only on full payment of the auction price. The auction
price shall, unless expressly otherwise agreed in writing before the auction (sale against invoice, payment by installments),
be paid immediately by bidders present in the hall, and either by prepayment immediately on receipt of invoice or by C.O.D. by
persons having submitted a written bid.
Payments due may be offset against money realised on proceeds from the sale of other items submitted to auction, provided that
sufficient cover exists for that purpose.
Anyone bidding for a third party shall stand jointly liabe with that third party for payment. Any risk attaching to a lot shall pass to
the bidder at the moment he the item is knocked down.
4. The lots shall remain the property of the original owners until they are paid for in full. In case of delayed payment, a 5% interest
shall be charged in arrears for each month‘s delay or part thereof in addition to a supplement on the invoice total. Delivery
of the purchased lot shall in all cases be at the buyer‘s expense and risk. The buyer shall pay the costs of transport where
desired.
II. LIABILITY
5. The lots are carefully and conscientiously described. In the case of lots that are depicted, the perforation, cut, postmark, etc.
shall be as shown in the picture.
6. The Auctioneers‘ liability:
a. In the case of stamps with written certificates of any kind the purchaser shall fully recognize the certificates mentioned in
the lot description, in the case of signed stamps, the genuineness as certified by the signature. This shall apply especially
to quality and genuineness. The Auctioneer will not assume any further liability in this respect.
b. In the case of uncertified stamps, the Auctioneer shall stand liable for the genuineness of the sold stamps for a period of
five years from the moment the item was knocked down.
c. In the case of lots comprising collections, no liability will be assumed nor complaints entertained in respect of doubles or
sets. This shall apply to lots comprising more than five stamps / letters / documents / items. Likewise the Auctioneer will
accept no liability with respect to lots with defects already described (even if all defects are not described in detail).
d. The liability of the Auctioneer for the quality of the lots shall expire one day after the purchaser has taken possession of
the items but shall in no case extend beyond five weeks from when they were knocked down, save if an extension of that
period be requested in writing stating why those reasons should be accepted by the Auctioneer.
III. COMPLAINTS
7. Complaints with respect to genuineness ( as 6.a. above) shall be accompanied by a letter stating that the item is false, written
by a competent expert who shall stand liabe for any error in his judgement.
8. Complaints with respect to quality shall always be made within the deadline set in 6.d. above.
9. The lots at issue in cases of complaint shall be returned in their original and unchanged form together with the lot sheet. Signs
or signatures appended by experts who assume liability for their claims shall not be considered changes. A buyer who is in
arrears with payment shall forfeit all rights to complain. Should the complaint prove justified, the lot will be taken back and the
price at which it was auctioned, any surcharges and lot charges will be reimbursed to the buyer. The cost of any counter-expertise
shall be paid to the person having put the item up for auction. If under the present Conditions of Auction, the complaint is
unjustified, the purchaser shall pay the full cost of the complaint.
IV. FINAL PROVISIONS
10. The Auction Administration reserves the right to exlude persons from the auction without giving any reason.
11. The present Conditions of Auction shall also apply to the open sale (returned items, etc.) of lots listed in the auction catalogue.
12. Place of performance and jurisdiction for both parties shall be the place in which the Auctioneers have their registered office,
although the Auctioneers shall be entitled to select another place of jurisdiction in individual cases. The placing of orders and
the commissioning of purchases shall imply full acceptance of the present Condiutions of Auction.
